So what is probate? Probate is basically the process of proving that the will is valid. Once the will is proved to be valid to the satisfaction of the court and the last will and testament of the person who is deceased the executor of the will can distribute the estate as per the deceased’s wishes.

The heirs must file a  will and a copy of the death certificate with the probate petition and all supporting documents to the circuit court so certain papers have to be filed but in New York, but there is a electronic filing system.
